Department of Justice Questioning the Selling Practices of Medtronic, Guidant and St. Jude BY JOHN CHOPACK, OCTOBER 26, 2005

Medtronic, Guidant and St. Jude Medical said they each received subpoenas from the U.S. Attorney in Massachusetts related to their heart devices.

Medtronic also stated that the subpoenas sought documents related to people in a position to recommend purchase of the devices, and the company's training and compliance materials covering fraud and abuse and anti-kickback statutes. St. Jude and Guidant didn't comment on any specifics.

It seems that the U.S. Department of Justice ("DOJ") is targeting the medical device industry. These subpoenas follow subpoenas sent to Biomet, DePuy, Smith & Nephew, Stryker and Zimmer in March for their promotion of their hip and knee products to surgeons. In the same investigation, orthopedic surgeons have have begun to receive subpoenas as well.

These investigations will likely take years to conclude and are likely to weigh heavy on the companies as related legal and administrative expenses continue to escalate.
